Tips On Your Legal RightsTitle. Double click me.
Don't be afraid of legislation
You probably think of Federal and State laws as being vast legalistic documents, impossible for anyone other than a lawyer to understand.
However this is not necessarily the case.
Laws written in the modern era, although couched in specific legal terms for validity, are usually readable enough for the majority of small business owners to attain a layman's grasp of rights and responsibilities.
Most if not all laws are freely available to the public on the internet.
For example, you can conduct a Google search such as 'Fair Work legislation Australia' and you will easily find the 'Fair Work Act, 2009' (https://www.fwc.gov.au/about-us/legislation-regulations/fair-work-act-2009 ).
Alternatively you can search directly on the relevant government agency's website where you will find a copy.
One way to speed up the search for your business's legal rights in any set of laws is to simply browse the index at the front of the legislation and look up the relevant topics.
Then just spend a little time reading carefully. You might be surprised how much power your SME really has.
There is nothing wrong with quoting the relevant section of any Act of Parliament to any public servant who may be a little unsure of its contents.
An additional tip: The word 'must' means that the provision is mandatory. The word 'may' however, indicates that a certain amount of discretion is provided for, OR that an alternative provision in the Act may be allowed.
Every word, including one in any preamble, is in an Act of Parliament for a very specific reason...and has the full force of the law behind it.
Once you have done some fundamental homework along these lines, you can take it to a lawyer for a proper legal opinion having cut down some of the work that lawyer would have had to do.
NOTE: Argos Consulting is not a law firm but we have access to legal services.
